Experts say appeal is unlikely – and CFTC must prove commodity market speculation before re-proposing limits

The Commodity Futures Trading Commission (CFTC) may struggle to revive its controversial position limits rule after it was rescinded by a US court last week. Former CFTC commissioners and lawyers say an appeal is unlikely given divisions within the agency over the rule, while re-proposing the regulation would now require the CFTC to demonstrate that limits are necessary – it was the regulator's failure to do this for the original rule that prompted the successful legal challenge.
